The Competition Tribunal accepted the complaint by Transbakn S.A. against Dictamen N° 1270 of the Honorable Comisión Preventiva Central, of August 28, 2003. The Dictamen stated that Transbank had abused its dominant position during 2001 and 2002, by charging discriminatory and abusive prices to retailers that took credit card payments, and that Transbank had a discriminatory tariff structure, against credit card emitters.
AThe Tribunal also ruled in favor of the National Economic Prosecutor’s Office, in a lawsuit against Transbank, for a discriminatory conduct consisting in reimbursing its partners a certain amount of money for fulfilled transactions, while not reimbursing those firms who were not its partners. The defendant had to pay a fine of 1000 Annual Tributary Units (around US$ 900,000).
