The Competition Tribunal dismissed a lawsuit by the National Economic Prosecutor’s Office against Integramédica S.A., for abuse of a dominant position and abuse of a situation of economic dependence, when it allegedly forced the doctors that worked in its health centers to hire integrated legal aid services and civil malpractice insurance with one company, under threats of separation from the company.
The Tribunal stated that Integramédica does not, and did not, have economic interests in the relevant market. Additionally, neither a dominant position of the defendant nor economic dependence of the doctors was proved. The alleged conduct was not proved either: the existence of a company policy directed to forcing doctors, under threat, to hire the described services with a specific company was not proved.
