The Competition Tribunal dismissed a lawsuit by the National Economic Prosecutor’s Office against Cámara de Comercio de Santiago A.G., for infringement of antitrust laws, by allegedly abusing its dominant position when imposing charges for clearing published debts in the Commercial Information Bulletin.
Regardless of this, the Tribunal recommended the Superintendencia de Bancos e Instituciones Financieras (the government’s bank regulatory and supervising agency) to adopt the necessary measures, so that supervised agents comply strictly with the obligation imposed by article 19°, second paragraph, of Law N° 19.628 on Protection of Private Life, transmitting to Cámara de Comercio de Santiago A.G. the information about payment or extinction of debts that were previously informed as not paid. The agents should pay the corresponding tariff, charging the original debtor for it. This should operate, at least, until January 1, 2010, date in which said tariff will be eliminated.
