The Competition Tribunal dismissed a lawsuit by Mr. Gonzalo Vallejos Mackay against Naviera Danvi Ship S.A.. The lawsuit was based on alleged abuse of dominant position and predatory practices, with the objective of maintaining said position in the market of bulk merchandise transportation to Easter Island.
In its ruling, the Competition Tribunal dismissed the plaintiff’s accusation, because the evidence presented in the case was not enough to conclude that the defendant had a dominant position in the market at the time the alleged conducts would have taken place. Furthermore, the Competition Tribunal declared that, even if Danvi Ship had had a dominant position, there was no evidence to prove that the defendant’s conducts constituted an infraction to the Competition Act.
