The Competition Tribunal accepted a lawsuit by Mr. Eugenio Patricio Saavedra Guajardo, Ms. Tatiana del Tránsito Fuenzalida Cáceres, Ms. Ana María Vargas Acevedo and Mr. Héctor Enrique Navarro Arrieta against Sindicato de Trabajadores Independientes y Pescadores Artesanales de Pichilemu (Labor Union of Independent Workers and Artisan Fishermen of Pichilemu, the “Union”), and declared that the latter infringed Article 3 of Decree Law N° 211 by forcing tenants of the cove it administered to offer the products they sold at a unique price, thereby restricting competition in the relevant market.
The Union was fined with 2 Annual Tributary Units, considering that the effects of the illicit conduct in the market were limited. The Tribunal did not fine the members of the Directive and the Administrative Committee of the Union, given that none of the persons that comprise these bodies had been sued.
