The Competition Tribunal dismissed a lawsuit by Ramírez y Compañía Limitada against the Ministry of Transportation and Telecommunications (“MTT”); the Tribunal stated that neither the creation of barriers to entry nor the collusive risks accused by the plaintiff were demonstrated, and that it is not possible to formulate objections to the allocation criteria used by the MTT from an antitrust point of view.
The Tribunal also dismissed a lawsuit by Guly Sociedad Anónima against MTT, because it was not proven that the requirement that bidders needed to be natural or juridical Chilean persons constituted in Chile prevented at least one foreign bidder from participating in at least one of the bidding processes. Furthermore, the Tribunal found that MTT justified this requirement on the need to ensure the proper performance of its public functions.
Ramírez y Compañía Limitada did not have to pay Court costs, while Guly did.
