The Competition Tribunal dismissed the lawsuit by Hotelera Rent A Home against Ilustre Municipalidad de Providencia (the Municipality of Providencia). The ruling states that, given the characteristics of the market, the acts of the Municipality could not have had a significant effect in the degree of competition in it.
Furthermore, the Tribunal considered that the Municipality of Providencia acted according to its normative attributions, and its acts were not an arbitrary exercise of its power with exclusory objectives. Consequently, its acts were not contrary to free competition, regardless of what can be established in other Tribunals or instances.
Lastly, even if the accusation that the Municipality has not monitored firms that provide the same services as Rent A Home adequately was true, this does not exempt the plaintiff from complying with the norms that regulate this economic activity, particularly the Municipal Ordinances N° 66 from 1995, and N° 2 from 2000, nor is it exempt from the potential judicial effects of not complying with them.
